THE PRESIDENT OF THE SECOND CHAMBER OF THE COURT OF JUSTICE,



after hearing the observations of the Advocate General, J. Kokott,

makes the following



Order

By letter lodged at the Court Registry on 5 November 2004, the Commission of the European Communities informed the Court of Justice, in accordance with Article 78 of the Rules of Procedure, that it was discontinuing its action.

By letter lodged at the Court Registry on 22 November 2004, the defendant informed the Court that it had no objection to such discontinuance.

Since neither of the parties has claimed costs, the Court decides, in accordance with the third paragraph of Article 69(5) of the Rules of Procedure, that each party must bear its own costs.

Under Article 69(4) of the Rules of Procedure, Member States which intervene in a dispute are to bear their own costs.




On those grounds, the President of the Second Chamber of the Court of Justice hereby orders:

1.
Case No C-272/02 is removed from the register of the Court.

2.
The parties are ordered to bear their own costs.

3.
The interveners are ordered to bear their own costs.
