makes the present

Order

1By application lodged with the Registry of the Court on 26April 2005, the Commission of the European Communities, represented by C.O’Reilly, acting as Agent, sought leave to intervene in Case C-77/05 in support of the form of order sought by the defendant.

2By application lodged with the Registry of the Court on 3May 2005, the Kingdom of Spain, represented by J.M. Rodríguez Cárcamo, acting as Agent, sought leave to intervene in Case C-77/05 in support of the form of order sought by the defendant.

3By application lodged with the Registry of the Court on 17May 2005, Ireland, represented by D.J. O’Hagan, acting as Agent, sought leave to intervene in Case C-77/05 in support of the form of order sought by the applicant.

4By application lodged with the Registry of the Court on 23May 2005, the Slovak Republic, represented by R.Procházka, acting as Agent, sought leave to intervene in Case C-77/05 in support of the form of order sought by the applicant.

5By application lodged with the Registry of the Court on 27May 2005, the Republic of Poland, represented by J.Pietras, acting as Agent, sought leave to intervene in Case C-77/05 in support of the form of order sought by the applicant.

6The applications for leave to intervene were lodged in accordance with Article93(1) of the Rules of Procedure and were submitted pursuant to the first paragraph of Article 40 of the Statute of the Court.

On those grounds, the President of the Court hereby orders:

1.The Commission of the European Communities is granted leave to intervene in Case C-77/05 in support of the form of order sought by the Council.

2.The Kingdom of Spain is granted leave to intervene in Case C-77/05 in support of the form of order sought by the Council.

3.Ireland is granted leave to intervene in Case C-77/05 in support of the form of order sought by the United Kingdom.

4.The Slovak Republic is granted leave to intervene in Case C‑77/05 in support of the form of order sought by the United Kingdom.

5.The Republic of Poland is granted leave to intervene in Case C‑77/05 in support of the form of order sought by the United Kingdom.

6.A period shall be determined within which the interveners shall set out the pleas in law in support of the respective forms of order which they seek.

7.The Registrar shall ensure that a copy of all procedural documents in the case is sent to the interveners.

8.Costs are reserved.
