THE PRESIDENT OF THE COURT,

after hearing the Advocate General, P.Mengozzi,

makes the following

Order

1By letter of 25 October 2007, the Registry of the Court sent the national tribunal a copy of the judgment in Case C-142/06 Olicom [2007] ECR I‑6675, requesting that tribunal to indicate whether, in the light of that judgment, it wished to maintain its reference for a preliminary ruling.

2By letter of 18 July 2008, received at the Court Registry on 22 July 2008, the VAT and Duties Tribunal, Manchester, informed the Court that it did not wish to maintain the reference.

3In those circumstances, the present case must be removed from the Register of the Court.

4Since these proceedings are, for the parties to the main proceedings, a step in the action pending before the national tribunal, the decision on costs is a matter for that tribunal.

On those grounds, the President of the Court hereby orders:

Case C-389/07 is removed from the Register of the Court.
