APPLICATION for annulment of the Commission Decision of 10February 2014 refusing to grant the applicant access to certain internal documents relating to the initiation of a circumvention investigation which resulted in Council Implementing Regulation (EU) No 723/2011 of 18 July 2011 extending the definitive anti-dumping duty imposed by Regulation (EC) No 91/2009 on imports of certain iron or steel fasteners originating in the People’s Republic of China to imports of certain iron or steel fasteners consigned from Malaysia, whether declared as originating in Malaysia or not (OJ2011L194,p.6).
1By letter lodged at the Court Registry on 17 July 2015, the applicant informed the Court, in accordance with Article125 of the Rules of Procedure of the General Court that she wished to discontinue proceedings. She sought no order as to costs.
2By letter lodged at the Court Registry on 5 August 2015, the defendant informed the Court that it takes note of the withdrawal of the application and requested, pursuant to Article 136(1) of the Rules of Procedure, that the applicant be ordered to pay the costs.
3Article136(1) of the Rules of Procedure provides that a party who discontinues or withdraws from proceedings is to be ordered to pay the costs if they have been applied for in the other party’s observations on the discontinuance. In the present case the defendant requested that the applicant be ordered to pay the costs.
4The case shall therefore be removed from the register and the applicant ordered to pay the costs.
On those grounds,
THE PRESIDENT OF THE FOURTH CHAMBER OF THE GENERAL COURT
hereby orders:
1)Case T-239/14 is removed from the register of the General Court.
2)Eva Monard shall pay the costs.
