ACTIONS brought against the decisions of the Fifth Board of Appeal of EUIPO of 10November 2020 (Case R527/2020-5), 19November 2020 (Case R529/2020-5) and 19November 2020 (Case R530/2020-5) relating to cancellation proceedings between About You and Safe-1 Immobilieninvest.

1By letter lodged at the Court Registry on 10December 2021, the applicant informed the Court, in accordance with Article125 of the Rules of Procedure of the General Court, that it wished to discontinue proceedings. It sought no order as to costs.

2By letter lodged at the Court Registry on 22December 2021, the defendant informed the Court that it had no observations to make concerning the discontinuance of the proceedings. It sought no order as to costs.

3The intervener did not submit any observations.

4Article 136(1) of the Rules of Procedure provides that a party who discontinues or withdraws from proceedings it to be ordered to pay the costs if they have been applied for in the other party’s observations on the discontinuance.

5Article136(4) of the Rules of Procedure provides that, where proceedings are discontinued, if costs are not claimed, the parties are to bear their own costs.

6The cases shall therefore be removed from the register and, in the absence of any claim in that regard, the parties ordered to bear their own costs.

On those grounds,

THE PRESIDENT OF THE FIFTH CHAMBER OF THE GENERAL COURT

hereby orders:

1.Cases T-23/21, T-50/21 and T-51/21 are removed from the register of the General Court.

2.Each party shall bear its own costs.
