In short, I do not consider that any arguable case has been put forward against VTBC. In those circumstances I give summary judgment for VTBC. It will follow that there is in the light of my judgment no basis for the court to assume judgment in respect of the claims against the other Defendants but I am not asked to make any order in that regard.

This case was well argued and well prepared on both sides.

I will give judgment remotely. I will deal with consequential matters on the basis of written submissions unless either party requires an oral hearing.
