In light of this judgment, I am satisfied that in relation to the remaining claims that Mode and Mr Tregunno have no real prospect of succeeding and the entirety of their respective claims should be struck out and/or summary judgment should be granted in favour of AXA. I am also satisfied that there is no compelling reason why those claims should be disposed of at trial.

I cannot immediately see that anything turns on whether the disposal is for strike out or summary judgment and I am content for both to be included in the order which I have approved.

Finally I am very grateful to all counsel for the helpful and incisive submissions and to their respective instructing solicitors for co-operating with the preparation of the bundle and the authorities to enable this case to be held efficiently and remotely.
