Mr Tregunno accepts that the 1774 Act claim does not confer any freestanding rights under the Policy and is relevant only if specific performance is granted in favour of Mode. For the reasons already set out, I am satisfied that Mode has no real prospect of succeeding in its claim for specific performance and so this head of claim also falls away.
