CONCLUSIONS

The dishonesty allegations may be relevant to questions of causation, in the manner summarised in section (D)(v) of this judgment. The Defendants should be given an opportunity to set out their position more precisely in that regard, probably in the form of draft amendments to their Replies, so that the Claimants can have a proper opportunity to consider and respond to them. The strike-out application should be adjourned in the meanwhile. I shall hear the parties on the appropriate directions.
