It follows and by way of conclusion that:

(1)

The application to adduce further witness evidence is allowed.

(2)

Neither the ‘Services Claim’ nor the ‘Transactional Claims’ are struck out.

(3)

Permission is given to FTL to bring the California law claim but on the basis that there is no relation back to the date that the proceedings were commenced but instead by reference to the date when the amendment application was issued in October 2024.
