MRI Trading (paragraph 27 above) was not referred to in Ramburs Inc, and according to the report at [2016] Bus. L. R. 135, Andrew Smith J was not referred in argument to any cases not mentioned in the judgment. That said, the CPR and Practice Directions should wherever possible be given effect simply in accordance with their terms; and certainly they should not be allowed, if it can be avoided, to be a potential trap for the unwary. Just on the language of CPR PD62 para 12.6, I respectfully agree with most, but not quite all, of Andrew Smith J’s view of its effect.
