Grant of permission to bring judicial review
I gave permission, on 23 August 2023, to bring judicial review proceedings. I did so on the grounds that it was arguable that the First-tier Tribunal had erred in law (i) in failing to take account of the medical records entries that pre-dated the RTA and showed back pain, and (ii) in failing to explain why, despite those entries, the back pain was not from the domestic violence. I gave for that decision the reasons reproduced at paragraphs 30 to 32 below.
