Conclusions
The local authority do not submit that this appeal has become academic, that issue having been raised by the Appellant. Despite the fact that the EHC Plan under consideration in this case has now been superseded, I shall nevertheless decide this appeal. The case has been fully argued by competent legal representatives and there are aspects of the grounds of appeal that might, depending on how they are resolved, be of wider interest.
Neither party asks the Upper Tribunal to hold a hearing before deciding this appeal. I have the benefit of fairly extensive written argument and in my view these allow me to decide this appeal fairly without holding a hearing.
