The Upper Tribunal’s Jurisdiction.
Section 15(4) of the Tribunals, Courts and Enforcement Act 2007 (the 2007 Act) provides that in deciding whether to grant relief the Upper Tribunal must apply the principles that the High Court would apply in deciding to grant that relief on an application for judicial review. To succeed in the claim the Applicant must show that the Respondent, the FtT, has made a material error of law.
