However, it is my conclusion that it was a misdirection.
The Tribunal moved on to consider proportionality in the event that its conclusion on unfavourable treatment arising in consequence of disability was incorrect.
The legitimate aim as found by the Tribunal was maintaining College standards and discipline and removing the considerable burden managing DJ placed on staff members.
