Introduction

This is an appeal to the Upper Tribunal against the decision of the First-tier Tribunal (Health, Education and Social Care Chamber) (“the Tribunal”) dismissing the Applicant’s claims of breaches of section 15 and section 20 of the Equality Act 2010.

Upon an application being made by the Appellant, anonymity was granted to the Appellant and a restricted reporting order made under rule 14 of the Tribunal Procedure (Upper Tribunal) Rules 2008 (SI 2008/2698). Given the Appellant’s age, disability issues and the alleged circumstances recounted in the Tribunal decision, anonymity is appropriate. Anonymity was not granted with regard to the Responsible Body. That application was opposed by the Appellant. The participants will not be named within this decision and although it may not be difficult to determine who they are by reference to the name of the Responsible Body, this decision is very unlikely to make any findings or conclusions relating to their personal conduct such that an Article 8 issue arises.
