The Tribunal concluded that DJ’s behaviours did not arise from his disability and dismissed the claim for that reason. Alternatively, the Tribunal concluded that, if it was wrong on that point, the College had proved that the decision to require DJ to be withdrawn was a reasonable and proportionate response to the circumstances. The Tribunal also concluded that aside from the requirement for DJ to enter into the contract, no other reasonable adjustment in the form of additional provision for him would have been either practicable or effective.
