Conclusion
I conclude that the decision of the First-tier Tribunal dated 12 January 2023 involves an error of law. I therefore allow the Appellant’s appeal and set aside the First-tier Tribunal’s decision. I remit the case for reconsideration by the First-tier Tribunal (Tribunals, Courts and Enforcement Act 2007, section 12(2)(b)(i)). My decision is also as set out above.
