Conclusion
I conclude that the decision of the First-tier Tribunal dated 28 November 2022 involves an error of law. I therefore allow the Appellant’s appeal. However, for the reasons explained above, I do not set aside the First-tier Tribunal’s decision. (Tribunals, Courts and Enforcement Act 2007, section 12(2)(a)). My decision is also as set out above.
