Neither party asked for an oral hearing of this appeal. I took their preferences into account. Having considered the electronic file and the audio recording of the First-tier Tribunal hearing on 14 July 2023 and given the parties agree the Tribunal made errors of law in its decision, I decided the interests of justice did not require an oral hearing. Ordering an oral hearing of the appeal will simply delay the resolution of WB’s appeal and it is clear from his representations that WB wants it resolved quickly. I therefore decided to determine the appeal on the papers.
