I should add that paragraph 8 of the First-tier Tribunal’s reasons records the Commissioner’s acknowledgement that paragraphs 38 and 39 of his decision notice contained factual errors “relating to claims made” by Mr Dally. However, these errors were not considered relevant to the merits of Mr Dally’s appeal.
