These reasons describe the Commissioner’s ‘open’ arguments that is arguments which may be presented to Mr Dally without revealing the nature of the withheld information. A separate document, containing the Upper Tribunal’s ‘closed’ reasons, deals with the Commissioner’s closed arguments.
