Failure to engage with key points
The Cabinet Office had pursued seven arguments which related to the public interest balancing test. The arguments themselves were listed in the Tribunal’s decision at [25], but the consideration section of the decision did not adequately address several of the points, namely 1, 2, 4 and 7:
