In his Response, the ICO pointed out that the Tribunal seemed to have placed weight on other factors, including “the unlawful prorogation of Parliament by the Prime Minister, a general election and the withdrawal from the EU” and the timing of the Cabinet Office’s Response, being “communicated on ‘a good day to bury bad news’” (at [40-41]). It was not clear to what extent those considerations formed part of the Tribunal’s ratio for reaching its decision, but certainly they were all irrelevant to the issues which it was determining.
