The ICO invited the Tribunal to consider the various ways in which the Tribunal’s basis for dismissing the appeal diverged significantly from the reasons advanced by him at the hearing, as set out above. In that context, the following submissions primarily approached the issues afresh rather than with reference to the Tribunal’s analysis.
