For the reasons set out above, we do not think that there were any exceptional circumstances which prevented the Appellant from applying earlier. We appreciate that he was suffering and continues to suffer from, mental injury but this, in itself was not an exceptional circumstance which prevented an application. We also think that, even if there were exceptional circumstances, in order to resolve the issues in this claim further extensive enquiries would be necessary. For the reasons set out above, we agree with the Authority and dismiss the appeal.”
