For these reasons, the Applicant submitted that the Upper Tribunal should quash the decision of the Tribunal to refuse the appeal against the decision of CICA not to waive the time limit for claiming an award under the 2012 Scheme and remit the matter to another Tribunal for a fresh hearing.
