19.

By paragraph 89 of the 2012 Scheme, a claims officer may extend the period for claiming compensation when satisfied that:

“(a)

due to exceptional circumstances the applicant could not have applied earlier and

(b)

the evidence presented in support of the application means that it can be determined without further extensive enquiries.”

20.

The test under paragraph 89(a) can be split into two subsidiary questions (BC v First-Tier Tribunal and Criminal Injuries Compensation Authority [2016] UKUT 0155 (AAC) (“BC”)):

(a)

why was the applicant unable to make the application earlier than he did?
