The Information Commissioner’s proposed grounds of appeal are two-fold. The first ground (‘Ground 1’) is that the FTT Judge failed to give reasons for her direction as to the responsibility for the preparation of the open bundle and misdirected herself as to the relevant law. The second ground (‘Ground 2’) is that the Judge’s direction was itself unreasonable and contrary to the overriding objective. I agree with Mr Knight that it is best to consider these grounds in reverse order, thus enabling the focus to be on the substance rather than the form.
