I gave permission, on 26 March 2025, to make this appeal. I did so on the grounds that it was arguable, for the reasons at paragraphs 18 to 39 below, that the First-tier Tribunal had erred in law in the ways set out those paragraphs.

I proposed that the Upper Tribunal set aside the First-tier Tribunal decision for the reasons given in my grant of permission. I proposed that the Upper Tribunal remit to the First-tier Tribunal for re-determination entirely afresh by the First-tier Tribunal.
