Article 2(2)(a) GDPR: material scope

The first major issue we had to consider was whether any of the four exclusions in Article 2(2) GDPR applies to take Clearview's processing outside the material scope of regulation under the GDPR and, given the way that Article 2(1) of the UK GDPR operates, outside the UK GDPR. Of the four exclusions in Article 2(2), it was agreed that only two were relevant to the circumstances of this appeal:

a.

Article 2(2)(a), which excludes processing "in the course of an activity which falls outside the scope of Union law"; and

b.

Article 2(2)(d), which excludes processing "by competent authorities for the purposes of the prevention, investigation, detection or prosecution of criminal offences or the execution of criminal penalties, including the safeguarding against and the prevention of threats to public security".
