NJ. In that case the claimant was deployed as an Army ski coach. While on duty as head coach at a championship a civilian skier collided with her. The Upper Tribunal held that the injury was caused by service on the basis that skiing was an aspect of service and the claimant was actively engaged in that service at the time of the injury. Service would often provide the “setting”, whether or not the case was one of “service cause”, and assessing whether service provided the “setting” was of limited use as a touchstone of causation.
