The Trust did not expand upon either ground 6, the PSED, or ground 7, failure to adequately consult in oral submissions. Neither grounds are arguable. There is nothing to suggest that the Council failed in its PSED and the highest it is put by the Trust in its written grounds is that the decision to move the library and dispose of the asset “may” have had a disproportionate impact on specific groups with protected characteristics. If there was any basis for a challenge, that is a challenge to the earlier decision in 2022 to move the library to MUCH and the decision in September 2024 to declare the Carnegie Library Building to be surplus to requirements. Similarly, ground 7 is with respect to the earlier decisions to move the library and dispose of the Carnegie Library Building.
