This was a ‘rolled up’ hearing. The court accordingly needs to resolve the issue of permission to apply for judicial review. I consider that permission should be granted for FTDIHL to bring an application for judicial review on all the grounds contained in its Re-Amended Statement of Facts and Grounds. I will proceed, accordingly, to consider their substantive merits.
