Grounds 1 and 2 are dismissed. In the circumstances, it is not necessary for me to address the First Defendant’s submissions on the alternative remedy available to the Claimant, namely, an application under section 73 TCPA 1990 to vary Condition 6, if or when circumstances change.

For the reasons set out above, the claim for statutory review is dismissed.
