Unlawful Conduct
Section 241 of POCA 2002 defines unlawful conduct as conduct occurring in the United Kingdom (“UK”) that is unlawful under its criminal law. It also extends to conduct occurring outside the UK if it is unlawful under the criminal law applying there and would be unlawful under UK criminal law if it occurred here. For the purposes of civil recovery, the court must decide on a balance of probabilities whether matters alleged to constitute unlawful conduct have occurred.
