I accordingly conclude that I should order Julian to pay the respondents’ costs of the appeal on the indemnity basis, to be subject to detailed assessment if not agreed, with interest running on those costs at 2% above base rate from when they were paid to judgment. Julian is to pay £38,832 on account of costs by 4 pm on 20 October 2025. Finally, Julian will not be entitled to any indemnity out of the estates or the trust fund for his own costs of the appeal or for the costs liability which he has incurred towards the respondents.
