I will therefore order that the claimant is entitled to her costs of the claim, on the indemnity basis, out of the estate, to the extent that they are not recovered from the first defendant. Since the claimant is to be the administratrix of the estate, it will prima facie be her duty to seek to recover those costs from the first defendant in the first instance.
