For the reasons which I have set out in this judgment the Appeal fails, and falls to be dismissed.

I will hear the parties further, as necessary, on any matters arising consequential upon the dismissal of the Appeal. In the usual way the parties are encouraged to agree as much as they can, subject to my approval, in relation to consequential matters.
