This is the application of Manolete Partners Plc (‘the Applicant’) by application notice issued on 30 January 2024 against Mr Trevor Howarth (‘the Respondent’) seeking orders under sections 238 and 239 of the Insolvency Act 1986 (IA 1986) in respect of payments totalling £101,000 (‘the Payments’) made to the Respondent by One Legal Services (trading as One Legal) Limited (‘the Company’) of which the Respondent was one of two directors.
The Payments were made by the Company to the Respondent between 25 April 2019 and 2 December 2019, during the course of a trading CVA which the Company entered on 22 February 2019 and which terminated on 17 December 2019. Mr Robert Adamson and Mr Kienlen (both of Armstrong Watson LLP) (‘AW’) were both supervisors of the CVA but only Mr Adamson played any part in the same.
