All the parties need the court to determine whether the defendants are the Rutland Trustees.

It seems to me that the differences between the claimants, the defendants and potentially Vicki’s estate are such that the only sensible way forward is to give permission for the defendants to advance their counterclaim.

The parties asked that I determine whether the defendants were Rutland Trustees and, in that context, also made submissions on whether there had been any assent of assets to the Rutland Trust.
