14.Miss Clare Montgomery QC appeared for Dosanjh and advances two grounds of appeal the first of which was common to all three appellants. Ground 1: wrong in principle. 15.Miss Montgomery insists that a “significant and growing discrepancy” has become apparent in penalties for common law and statutory offences. Unless this “anomaly” is properly addressed by the court, a prosecutor may simply ignore any restrictions imposed by statute and choose to charge an offence where no time limits apply or the penalty is at large.
