Section 1

1.

On 23 January 2019 at the Crown Court sitting in Luton before HHJ Mensah, the applicant was convicted unanimously on a retrial of offences of fraud and perverting the course of public justice (counts 1 and 2) and three counts of fraud (counts 6 to 8). On 24 January 2019 he was sentenced as follows:

i)

On indictment 20167142 (count 1), which was an offence of fraud contrary to section 1 of the Fraud Act, he was sentenced to 5 years' imprisonment.

ii)

On count 2 of the same indictment, an offence of perverting the course of justice contrary to common law, he was sentenced to 2 years and 6 months.

iii)

Under indictment T20170359 (count 6), which was a charge of fraud contrary to section 1 of the Fraud Act 2006, he was sentenced to 3 years consecutive to count 1.

iv)

On count 7 of the same indictment, another offence of fraud, he was sentenced to 2 years' imprisonment and

v)

On count 8, which was a third offence of fraud, he was sentenced to 1 year imprisonment.

The total sentence was therefore 8 years' imprisonment. The applicant had a co-accused, his wife, Anne-Louise McGrath, who was acquitted on counts 3 to 8.

The applicant now renews his application for leave to appeal against his conviction, having been refused leave by the single judge in April 2021. Because of the extreme delays that we shall outline, he requires an extension of approximately 6 years to rely upon the grounds of appeal that he now wishes to pursue.
