Evaluation of the Evidence
30.Having regard to those legal principles, I turn to my evaluation of the evidence in this case. The behaviour and evidence of AB, CD and EF has not always been conventional and I have had the particular advantage of seeing and hearing their oral evidence. There has been a lack of candour on the part of them and GH such that it has been difficult to discern the truth of what has happened in this case. I remind myself that the burden of proof lies with the party making an allegation and that the standard of proof is the civil standard of the balance of probabilities. Whilst, for convenience, I set out my evaluation of the evidence under sub-titles below, I have evaluated the evidence as a whole as a broad canvas.
