Can a company be liable?
The operative part of s 201(1)(d) provides that the settlor is liable (among other things) where the transfer is made “during the life of the settlor”.
We were provided with the Cambridge Dictionary definition of “life”, which includes the following entries:
“Life noun (Time alive): The period between birth and death, or the experience or state of being alive
Life noun (Time of operation): The period for which a machine or organization lasts.”
