77.FBT’s claims for loss of an opportunity in respect of plans to sell vinyl record and to make a film do not succeed. FBT would not in fact have granted a licence to LTEV for the infringements committed so that there is no loss of licence. 78.Damages should be assessed on the basis of a fee for a notional licence to make 2,981 infringing copies and are £7,452.50. That figure should bear appropriate interest.
