The sole witness to appear before me for the Claimant was Ms Fletcher. I found her to be an honest witness, although much of her evidence was irrelevant or amounted to no more than opinion, and much of it reflected her views of the merits or her concerns about losses caused to the Claimant, rather than the profits made by Battle. A witness statement was also filed from Matthew Cummins. He was not cross-examined. His evidence does not appear to me to be relevant to any of the issues I have to decide.
