The Defendant’s application
The Defendant’s application is in two parts. In the first place, as I have said, an application is made under CPR Part 11, for an order that the court does not have jurisdiction, and that The First, Second, Third and Fourth Extension Orders be set aside. I will call this, for convenience, the ‘Set Aside Application’. Secondly, an order that the court should not exercise any jurisdiction it may have and that the claim should be stayed. I will call this the ‘Stay Application’.
