Conclusion
Given the conclusions I have arrived at on each of Grounds 1-4, I am satisfied that there is no real prospect of Ardmore successfully defending the claim on any of the Grounds identified. There is no other compelling reason why the case should be disposed of at trial.
Accordingly, the Decision falls to be enforced by way of summary judgment and I grant judgment in favour of BDW in the sum of £14,539,243.45, together with interest and costs.
