For the reasons set out above, I have concluded that the Application was a valid application in accordance with the Act and the Scheme. Formations are not entitled to any of the declarations which they seek and these Part 8 proceedings should be dismissed.

I would invite Counsel to agree any consequential matters or, failing agreement, these matters should be dealt with in brief written submissions.
